What are the penalties in Maryland for repeat drug DWI convictions?

Penalties for a first time Maryland drug DWI conviction

Those convicted for a first-time DWI offense could be subject to the following punishments:

  • 2 months of imprisonment
  • $500 in fines
  • MVA penalties including points and license suspension
  • A misdemeanor

Penalties for a second Maryland drug DWI conviction

Those convicted for a second offense could be subject to the following punishments:

  • One year of imprisonment
  • $500 in fines
  • MVA penalties including points and license suspension
  • A misdemeanor

Penalties for a third Maryland drug DWI conviction

  • Up to three years of imprisonment
  • Fines up to $3,000
  • MVA penalties such as points and license suspension or revocation
  • A misdemeanor

Convictions within five years of each other have additional requirements:

  • Mandatory minimum jail time from five to 10 days or community service from 30 to 60 days
  • Mandatory alcohol or drug abuse assessment
