Have you been injured in a serious accident? Did you suffer harm at the hands of a negligent medical professional? Did a defective product cause you or a loved one to experience catastrophic injuries?

If you were injured or lost a loved one and someone else is to blame, you may be able to pursue financial compensation from that person or company to pay for: medical bills, lost earnings, emotional trauma, funeral costs, pain and suffering and possibly more.

The insurance companies that are supposed to pay for your damages are notorious for undervaluing claims and denying the liability of their policyholders. It takes a competent personal injury law firm to make sure your rights are represented in these complex cases. Maronick Law LLC is the firm you need if you or a loved one suffered a serious injury. We help those in need throughout all of Maryland.

Understanding Liability In A Personal Injury Lawsuit

Liability, or legal responsibility, is a primary issue in a personal injury lawsuit. As the injured party (plaintiff) bringing a lawsuit against an allegedly at-fault party (defendant), you must prove that they are responsible for your injuries.

In Maryland, liability may be established by proving:

  • The defendant owed a certain duty of care to provide a certain level of care, or to act in a reasonably safe manner, based on the circumstances at hand.
  • The defendant breached this duty.
  • The plaintiff was injured.
  • The defendant’s breach was the proximate (immediate) cause of the plaintiff’s injuries.

The burden of proof in personal injury cases is based on a preponderance of the evidence, meaning the plaintiff must show it is more than likely true that the defendant is liable. This varies from criminal cases, which require proof beyond a reasonable doubt.
