A DUI Record Expungement Attorney in Anne Arundel County, MD, Can Help You Understand What Can and Cannot Be Cleared

Many people assume a DUI can eventually be cleared from their record, like other old charges. In Maryland, the answer depends almost entirely on how the case ended. Our Maryland DUI expungement lawyers at Maronick Law LLC help clients understand which DUI outcomes can be removed from public view, which ones cannot, and what the waiting periods look like for each. Drawing on our extensive background in DUI/DWI defense matters, we guide people considering expungement based on their individual circumstances, not theoretical what-ifs.

The details matter. A DUI conviction generally stays on your record permanently. A charge that ended in an acquittal, dismissal, nolle prosequi, or stet, and in some cases a probation before judgment, may be eligible for expungement. If you are facing charges now, the outcome of your case today will shape what your record looks like years from now.

If you’re tired of carrying the consequences of an old DUI or DWI charge, it’s time to take back control by exploring paths to record removal. Schedule a free consultation with a DUI record expungement attorney in Anne Arundel County, MD, to discuss your options.

A DUI Conviction Generally Cannot Be Expunged in Maryland

Maryland allows certain criminal convictions to be expunged after a waiting period, but only if the offense appears on the list of eligible convictions in Criminal Procedure § 10-110.

Driving under the influence and driving while impaired, under Transportation Article § 21-902, are not on that list. As a result, a guilty finding for DUI or DWI generally remains part of your court record indefinitely.

That record can surface long after the case ends. Court records appear on Maryland Judiciary Case Search, and a DUI conviction may come up during employment screenings, professional licensing reviews, and housing applications.

Because the law treats convictions so differently from other outcomes, the way your case resolves matters as much for your future record as it does for the immediate penalties. Maryland's broader expungement rules for other offenses work differently, which is why DUI cases require their own analysis.

Case Outcomes That Our Maryland DUI Expungement Lawyers May Be Able to Help You Clear From Your Record

Not every DUI charge ends in a conviction. Several other outcomes leave the door open to expungement, though each works a little differently.

Acquittal

If a judge or jury finds you not guilty, the State failed to prove its case. An acquittal is generally eligible for expungement, which allows the arrest and court records associated with the charge to be removed from public view.

Dismissal

A court may dismiss a DUI charge for reasons such as a successful suppression motion, a procedural defect, or the State's inability to proceed. Dismissed charges are generally eligible for expungement on the same basis as an acquittal.

Nolle Prosequi

A nolle prosequi, often called a "nol pros," means the prosecutor has formally decided not to pursue the charge. This commonly happens when evidence problems surface or as part of a negotiated resolution involving other charges. A nolle prosequi is generally eligible for expungement.

Stet

When a case is placed on the stet docket, it is postponed indefinitely, often with conditions attached. A stetted charge can typically be expunged after a waiting period. Under Maryland’s 2025 Expungement Reform Act, effective January 31, 2026, charges that have remained on the stet docket for at least three years are also removed from Maryland Judiciary Case Search.

Timelines vary by disposition, and each of these outcomes is also subject to Maryland’s unit rule.

Probation Before Judgment Is Now Eligible for Expungement in Maryland After a Long Waiting Period

Probation before judgment allows a court to place you on probation without entering a conviction. For DUI cases, PBJ has long been valuable for avoiding a conviction, but for decades, it came with a major drawback: Maryland law barred DUI PBJs from ever being expunged.

That changed in 2024. Under the amended Criminal Procedure § 10-105, a person who received a PBJ for driving under the influence or driving while impaired by alcohol under Transportation Article § 21-902(a) or (b) may petition for expungement, subject to strict conditions:

  • Waiting period: The petition may not be filed within 15 years after you were discharged from probation.
  • No new convictions: You cannot have been convicted of a crime, other than a minor traffic violation, within 15 years after the PBJ was entered.
  • No new DUI PBJ: You cannot have received another PBJ for a § 21-902 offense within that same 15-year period.
  • No pending cases: You cannot be a defendant in a pending criminal proceeding when you file.

The change also applies to PBJs entered before the law took effect, so people with older DUI PBJs may now have a path forward.

A PBJ for a drug-related impaired driving charge may be treated differently, and eligibility should be confirmed before filing.

The conditions and supervision that come with a PBJ are part of DUI probation, which can last for months or years before the 15-year clock even begins.

A single DUI arrest may produce more than a single charge. Officers commonly issue several citations at once, such as driving under the influence, driving under the influence per se, driving while impaired, and related traffic offenses. Maryland treats charges arising from the same incident as a unit for expungement purposes.

If any charge in the unit is not eligible for expungement, none of the charges in that unit can be expunged. That means a common DUI resolution, a guilty finding on one count with the remaining counts nolle prossed, generally leaves every charge from that arrest on your record. The nolle prosequi dispositions that would otherwise qualify remain visible because they share a unit with an ineligible conviction.

Our Maryland DUI expungement lawyers review every charge in a case, not just the most serious one, when evaluating what may be possible now and what may become possible in the future.

MVA Driving Records Are Separate From Court Records, so DUI Expungement May Not Clear the Offense for Every Purpose

Expungement under the Criminal Procedure Article addresses court and police records. Your driving record with the Motor Vehicle Administration follows its own rules, and alcohol-related entries are among the most difficult to remove.

Maryland's driving record expungement provisions exclude drivers with certain alcohol-related dispositions, so a DUI may remain on your MVA record even after court records are cleared.

This distinction matters for insurance, commercial driving, and future MVA proceedings, where your driving history can carry weight independently of your criminal record.

Facing DUI Charges? The Outcome of Your DUI Case Today Determines Your Expungement Options Later

For anyone facing a DUI charge now, expungement is not a distant concern to worry about later. It is one of the most important long-term consequences to weigh while the case is still open. The difference between outcomes is significant:

  • Acquittal, dismissal, or nolle prosequi: Generally eligible for expungement after a relatively short waiting period
  • Stet: Generally eligible after a waiting period
  • Probation before judgment: Potentially eligible, but only after 15 years and a clean record
  • Conviction: Generally not eligible

A DUI record expungement attorney in Anne Arundel County, MD, can factor these differences into every decision, from pretrial motions to negotiations over which charges are resolved and how. When a DUI plea bargain is on the table, understanding how each option affects your future record can change which option makes the most sense.

Our Maryland DUI expungement lawyers keep your long-term record in view throughout the case, not only after it ends.
