
A 59-year old resident of Mt. Pleasant, PA was arrested and charged in connection to the death of David Linsenbigler. In February 2025, Ricky A. Wise and Linsenbigler were riding a side-by-side (also known as a utility task vehicle) when it accidentally broke the ice at Deep Creek Lake. Linsenbigler, who was trapped under the ice, passed away from his injuries the following day.
Wise reportedly had a blood alcohol level over the legal limit at the time of the incident. He was arrested and is now facing criminal charges. “This case is a tragedy,” says Wise’s defense attorney, Tom Maronick.
Tragic Incident Leads to Negligent Manslaughter Charges for Mt. Pleasant Resident
Shortly after 5:30 p.m. on Feb. 22, 2025, Wise and Linsenbigler’s 2014 Polaris RZR XP 1000 fell through the ice at Deep Creek Lake near the Glendale Bridge, immediately submerging the two friends. Wise, who was driving the side-by-side was able to escape, however Linsenbigler remained trapped beneath the ice until first responders arrived.
Upon rescue, Linsenbigler was transferred to J.W. Ruby Hospital where he died the following day. Wise was transferred to Garrett Regional Medical Center and treated for hypothermia and near-drowning, but was released the following day.
An investigation revealed that Wise had been under the influence and had a BAC over the legal limit (0.08%). He was subsequently arrested and charged with negligent manslaughter with a vehicle, negligent homicide by motor vehicle while under the influence, homicide with a motor vehicle while impaired, DUI, and related charges. If convicted, he faces a fine of $16,700 and/or 12 years and two months in prison.

We look forward to our day in court and the opportunity to defend Mr. Wise.” Wise’s trial began on October 7, 2025.
The use of off-road vehicles, like the one Wise and Linsenbigler were using, are prohibited within the Deep Creek Lake Natural Resources Management Area.
