Driving 30 MPH Over the Limit? Maryland’s New Law Could Mean Jail Time

Maryland has always treated traffic offenses seriously. However, now, drivers who go more than 30 miles per hour over the speed limit can be charged with reckless driving. The new penalties are the result of the recently passed Sergeant Patrick Kepp Act.

Sergeant Patrick Kepp Act Raises Penalties for Maryland Drivers

The Sergeant Patrick Kepp Act was named after Montgomery County police officer, Patrick Kemp, who lost both of his legs after being struck by a speeding repeat offender. The incident, which occurred while Kemp was in the line of duty, highlighted the state’s urgent need for stronger laws to deter repeat speeding offenses and keep the roads safe.

Prior to the act, most speeding offenses resulted in points and fines. For example, going 30 miles over the speed limit resulted in five points on your driving record and a $290 fine. However, now, those going at least 30mph over the speed limit are facing six license points, a $1,000 fine and up to 60 days in jail.

After getting a speeding ticket, Maryland residents traditionally sought legal counsel to protect against fines and higher insurance rates. But now, residents need legal counsel to help protect their future.

A reckless driving charge has consequences that go way beyond fines. With the possibility of 60 days behind bars, those driving over the speed limit could face significant limitations on their ability to obtain loans, secure employment, and even work in specific industries that require a clean driving record. Though the Sergeant Patrick Kepp Act has been passed into law, many Maryland residents are unaware of the steep penalties that now accompany driving 30 miles per hour or more over the speed limit.
